Description Position Title: Immigration Staff AttorneyOrganization: Jewish Family Service of San DiegoPosition Type: FT, exemptPay Rate: Commensurate with experienceBenefits:Benefits for this position include a 401(k) plan, medical, dental and vision coverage, flexible spending accounts, life insurance and generous holiday benefits.Position overview:Jewish Family Service of San Diego (JFS) is one of four refugee resettlement agencies in San Diego County, a Department of Justice Recognized organization, and a core partner of the San Diego Rapid Response Network (SDRRN) - a group of 40+ immigrant rights and social service organizations, attorneys and community leaders who educate, protect and assist immigrant individuals and families - including refugees and asylum seekers - with legal support and social services. JFS has a large Immigration Services Department (JFS-ISD) where it not only coordinates the legal services for SDRRN, but also has a large team of lawyers, DOJ accredited representatives, and support staff working on a wide range services for low-income and vulnerable immigrants in San Diego and Imperial counties. The JFS-ISD team specializes in removal defense, family-based petitions and applications, naturalization, and humanitarian relief. The JFS-ISD team has experience and regularly practices immigration law before U.S. Citizenship and Immigration Services (USCIS), the Executive Office for Immigration Review (EOIR) at the San Diego and Otay Mesa Immigration Courts and Board of Immigration Appeals (BIA), and the U.S. Court of Appeals for the Ninth Circuit and also guardianship law before the San Diego Probate Court. JFS-ISD is also the legal service provider which coordinates the Higher Education Legal Services (HELS) program on the 2 CA State Universities - San Diego State and CSU San Marcos, in addition to 9 community colleges in San Diego and Imperial counties.Under the supervision of the Removal Defense Supervising Immigration Attorney, the Immigration Staff Attorney will be responsible for providing direct legal representation to JFS clients in immigration cases, including representation before EOIR, BIA, Federal Circuit Courts, and the USCIS, while helping to support the broader efforts of the JFS Immigration Services Team. The Immigration Staff Attorney will provide direct legal representation in defensive and affirmative cases to individuals seeking asylum, withholding of removal, and Convention Against Torture protection; adults and children affirmatively seeking asylum; children seeking Special Immigrant Juvenile Status; and crime victims seeking VAWA classification or U visas, among other immigration benefits. The Immigration Staff Attorney will also provide critical emergent intervention in support of the SDRRN.The Immigration Staff Attorney must be passionate about providing culturally competent, trauma-informed, expert legal defense of human rights to noncitizens and newcomers in San Diego County and generally in the San Diego border region, including but not limited Tijuana/Mexicali, Mexico.Responsibilities:

  • Provide direct emergency and non-emergency removal defense and removal enforcement representation for the SDRRN, including representation for migrants, noncitizens, and newcomers before Customs and Border Protection (CBP), Border Patrol (BP), Immigration and Customs Enforcement (ICE), the San Diego Immigration Court, the Otay Mesa Immigration Court, other Immigration Courts across the country when required, and before the USCIS, as well as potential appellate work before the Board of Immigration Appeals (BIA) and Federal Courts;
  • Oversee and provide legal orientation, counseling, and education regarding a range of immigration issues and other legal problems faced by members of the low-income immigrant communities in San Diego County and Tijuana, Mexico;
  • Manage a full active removal defense caseload, including representation of individuals and families subject to the Migrant Protection Protocols (MPP) program;
  • Under the supervision of JFS's Removal Defense Supervising Immigration Attorney, support JFS's immigration team, including the DOJ accredited representatives, pro bono attorneys, and other staff as assigned, through regular engagement, case assistance and mentorship;
  • Oversee and provide legal orientation, counseling and education regarding a range of immigration issues and other legal problems faced by members of the low-income immigrant communities that JFS serves;
  • Stay up to date on rapidly changing immigration laws and policies; and
  • Comply with Immigrant Services Department, Program, and agency wide policies and procedures, data and case management policies and procedures, and program reporting requirements. Position Requirements Skills/Abilities that are a must-have:
    • Juris Doctorate degree with membership in good standing in the bar of any state and/or the District of Columbia;
    • Bilingual English/Spanish;
    • A minimum of 1-3 years of experience with immigration law, including removal defense work before the EOIR;
    • Excellent interpersonal skills, including good communication skills, listening skills, attention to detail and professional attitude;
    • Strong case management, legal research, and legal writing skills required;
    • Demonstrated ability and willingness to zealously pursue new and untested legal theories;
    • Demonstrated ability to take initiative and work under pressure required;
    • Ability to work both independently and in a group setting;
    • Ability to work flexible hours, including some evenings and weekends;
    • Valid driver's license, access to an automobile, insurance, and willingness to drive to off-site locations;
    • Passion for social justice for immigrants required.Skills/Abilities we'd like you to have:
      • Experience working with detained immigrants or other incarcerated populations;
      • Experience working with migrants in other countries, especially in Central America and Mexico;
      • Experience working with marginalized populations and survivors of trauma;
      • Experience with removal defense or the intersection of immigration and family law or criminal defense;
      • Dedication to serving immigrant communities with a sincere commitment to working on behalf of low income immigrants.
